Agreement to Terms

By accessing or using TCMX services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Services

TCMX provides an online store for businesses that sell over WhatsApp: a catalog, orders, payment by Pago Móvil, Zelle or bank transfer, and a dashboard to manage every order. It also offers add-on services that are contracted separately: a WhatsApp agent, social media content, wholesale sales and WhatsApp campaigns.

Pricing and Payment

  • All plans are billed on a month-to-month basis
  • You may cancel your subscription at any time without penalty
  • Prices are subject to change with 30 days written notice
  • Refunds are available within the first 30 days of service
  • Payment is due at the beginning of each billing cycle

User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information
  • Review and approve content before it is published
  • Maintain the security of your account credentials
  • Comply with all applicable social media platform policies
  • Not use our services for any illegal or unauthorized purpose

Intellectual Property

Content created by TCMX for your business becomes your property upon payment. TCMX retains the right to showcase anonymized work samples in our portfolio unless otherwise agreed in writing.

Limitation of Liability

TCMX shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

Termination

Either party may terminate the service agreement at any time. Upon termination, TCMX will provide all completed content and cease access to your social media accounts within 5 business days.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
